The Standing Committee on Justice and Human Rights has the honour to present its	Le Comité permanent de la justice et des droits de la personne a l’honneur de présenter son
SEVENTH REPORT	SEPTIÈME RAPPORT
In accordance with its Order of Reference of Wednesday, February 11, 1998, your Committee has considered Bill S-5, An Act to amend the Canada Evidence Act and the Criminal Code in respect of persons with disabilities, to amend the Canadian Human Rights Act in respect of persons with disabilities and other matters and to make consequential amendments to other Acts, and has agreed on Wednesday, April 1^st, 1998, to report it with the following amendments:	Conformément à son Ordre de renvoi du mercredi 11 février 1998, votre Comité a étudié le projet de loi S-5, Loi modifiant la Loi sur la preuve au Canada, le Code criminel et la Loi canadienne sur les droits de la personne relativement aux personnes handicapées et, en ce qui concerne la Loi canadienne sur les droits de la personne, à d’autres matières, et modifiant d’autres lois en conséquence, et a convenu le mercredi 1^er avril 1998 d’en faire rapport avec les amendements suivants :
Clause 2	Article 2
Replace lines 8 to 12 on page 3 with the following:	Substituer aux lignes 14 à 17, page 3, ce qui suit :
"dependency and who, for a sexual purpose, counsels or incites that person to touch, without that person’s consent, his or her own body, the body of the person who so counsels or incites, or the body of any other person, directly or indirectly, with a part of the body or with an object,"	« dance et qui, à des fins d’ordre sexuel, engage ou incite la personne handicapée à la toucher, à se toucher ou à toucher un tiers, sans son consentement, directement ou indirecte- »

Clause 20	Article 20
Replace lines 11 and 12 on page 11 with the following:	Substituer aux lignes 10 et 11, page 11, ce qui suit :

"(2) Subsections 27(2) to (4) of Act are replaced by the following:

(2) The Commission may, on application or on its own initiative, by order, issue a guideline setting out the extent to which and the manner in which, in the opinion of the Commission, any provision of this Act applies in a class of cases described in the guideline." Add after line 19 on page 11 the following:	Ajouter après la ligne 17, page 11, ce qui suit :

Clause 39	Article 39
Add after line 4 on page 28 the following:	Ajouter après la ligne 3, page 28, ce qui suit :
"(4.1) A member whose appointment expires may, with the approval of the Chairperson, conclude any hearing that the member has begun, and a person performing duties under this section is deemed to be a part-time member for the purposes of section 48.3 of the Canadian Human Rights Act."	« (4.1) Le membre dont le mandat est échu peut, avec l’agrément du président, terminer les affaires dont il est saisi. Il est alors réputé être un membre à temps partiel pour l’application de l’article 48.3 de la Loi canadienne sur les droits de la personne. »
Your Committee has ordered a reprint of Bill S-5, An Act to amend the Canada Evidence Act and the Criminal Code in respect of persons with disabilities, to amend the Canadian Human Rights Act in respect of persons with disabilities and other matters and to make consequential amendments to other Acts, as amended, as a working copy for the use of the House of Commons at the report stage.	Votre Comité a ordonné la réimpression du projet de loi S-5, Loi modifiant la Loi sur la preuve au Canada, le Code criminel et la Loi canadienne sur les droits de la personne relativement aux personnes handicapées et, en ce qui concerne la Loi canadienne sur les droits de la personne, à d’autres matières, et modifiant d’autres lois en conséquence, tel que modifié, pour servir de document de travail à la Chambre des communes à l’étape du rapport.
A copy of the Minutes of Proceedings relating to this Bill (Meetings Nos. 39 to 42, 44 to 46 and 49 of the 1^st Session of the 36^th Parliament) is tabled.	Un exemplaire des Procès-verbaux pertinents à ce projet de loi (réunions n^os39 à 42, 44 à 46 et 49 de la 1^ère Session de la 36^e Législature) est déposé.
