Pursuant to the Order of Reference of Tuesday, September 18, 2018, the Committee commenced consideration of Bill C-79, An Act to implement the Comprehensive and Progressive Agreement for Trans-Pacific Partnership between Canada, Australia, Brunei, Chile, Japan, Malaysia, Mexico, New Zealand, Peru, Singapore and Vietnam.

Bruce Christie made a statement and, with Julie Boisvert, answered questions.

At 11:58 a.m., the sitting was suspended.

At 12:08 p.m., the sitting resumed.

The Committee commenced its clause-by-clause study of the Bill.

Pursuant to Standing Order 75(1), consideration of Clause 1, Short Title, was postponed.

The Chair called Clause 2.

Hugh Cheetham, Kendal Hembroff, Bruce Christie, Andrea Flewelling and Mehmet Karman answered questions.

After debate, by unanimous consent, Clauses 2 to 4 inclusive carried on division severally.

Clause 5 carried on division.

Clause 6 carried on division.

On Clause 8,

Pursuant to the order adopted by the Committee on Tuesday, May 3, 2016, the following amendment, submitted by Elizabeth May for the consideration of the Committee, was deemed moved:

That Bill C-79, in Clause 8, be amended by replacing line 40 on page 3 with the following:

“Article 11.22 of the TPP.”

After debate, the question was put on the amendment of Elizabeth May and it was negatived on the following recorded division:

NAYS: Dean Allison, Colin Carrie, Sukh Dhaliwal, Peter Fonseca, Randy Hoback, Kyle Peterson, Terry Sheehan, Geng Tan — 8.

The Chair ruled that the following three (3) amendments were consequential to the previous amendment and therefore they were also negatived:

That Bill C-79, in Clause 9, be amended by replacing line 1 on page 4 with the following:

“9 The Agreement, except Section B of Chapter 9, is approved.”

That Bill C-79, in Clause 11, be amended by deleting lines 11 and 12 on page 4.

That Bill C-79, in Clause 12, be amended by replacing lines 3 to 7 on page 5 with the following:

“(c) the expenses incurred by panels established under the Agreement and the remuneration and expenses payable to the panellists on those panels and to any experts retained by those panels.”

Clause 8 carried on division.

On Clause 11,

Tracey Ramsey moved, — That Bill C-79, in Clause 11, be amended

(a) by replacing line 4 on page 4 with the following:

“11 (1) The Minister may, on the joint recommendation of the Minister of Labour and the Minister of the Environment,”

(b) by adding after line 12 on page 4 the following:

“(1.1) The Minister must, before exercising the powers referred to in subsection (1), provide opportunities for public participation.”

After debate, the question was put on the amendment of Tracey Ramsey and it was negatived on the following recorded division:

YEAS: Tracey Ramsey — 1;

NAYS: Dean Allison, Colin Carrie, Sukh Dhaliwal, Peter Fonseca, Randy Hoback, Kyle Peterson, Terry Sheehan, Geng Tan — 8.

Clause 11 carried on division.

On Clause 12,

Tracey Ramsey moved, — That Bill C-79, in Clause 12, be amended by adding after line 7 on page 5 the following:

“(2) As soon as feasible, but in any case within three months after the end of each year, the Minister must cause to be laid before each House of Parliament a report setting out the expenses incurred by the Commission during that year.”

After debate, by unanimous consent, the amendment was withdrawn.

By unanimous consent, Clause 12 was allowed to stand.

On new Clause 13.1,

Tracey Ramsey moved, — That Bill C-79 be amended by adding after line 26 on page 5 the following new clause:

“Annual Report

13.1 As soon as feasible, but in any case within three months after the end of each year, the Minister must cause to be laid before each House of Parliament a report setting out an analysis of the jobs created and jobs lost as a result of the Agreement, the balance of trade with each of the other parties to the Agreement and the measures taken to eliminate trade barrier other than tariff barriers.”

After debate, the question was put on the amendment of Tracey Ramsey and it was negatived on the following recorded division:
