The Standing Committee on Justice and Human Rights met at 3:31 p.m. this day, in Room 112-N, Centre Block, the Chair, Mike Wallace, presiding.

 

Members of the Committee present: Françoise Boivin, Blaine Calkins, Sean Casey, Bob Dechert, Robert Goguen, Ève Péclet, Kyle Seeback, Mike Wallace and David Wilks.

 

Acting Members present: Jean Crowder for Pierre Jacob.

 

Other Members present: Bruce Hyer.

 

In attendance: Library of Parliament: Lyne Casavant, Analyst; Dominique Valiquet, Analyst. House of Commons: Chloé O'Shaughnessy, Legislative Clerk.

 

Witnesses: Randy Hoback, M.P., Prince Albert. Department of Justice: Carole Morency, Director General and Senior General Counsel, Criminal Law Policy Section; Michael Zigayer, Senior Counsel, Criminal Law Policy Section.

 
Pursuant to the Order of Reference of Wednesday, October 8, 2014, the Committee commenced consideration of Bill C-590, An Act to amend the Criminal Code (blood alcohol content).
 

Randy Hoback made a statement and answered questions.

 

At 4:16 p.m., the sitting was suspended.

At 4:18 p.m., the sitting resumed.

 
Pursuant to the Order of Reference of Friday, November 28, 2014, the Committee resumed consideration of Bill C-35, An Act to amend the Criminal Code (law enforcement animals, military animals and service animals).
 

Michael Zigayer answered questions.

 

The Committee commenced its clause-by-clause study of the Bill.

 

Pursuant to Standing Order 75(1), consideration of Clause 1, Short Title, was postponed.

The Chair called Clause 2.

 

On Clause 2,

Pursuant to the order adopted by the Committee on Tuesday, October 29, 2013, the following amendment, submitted by Bruce Hyer for the consideration of the Committee, was deemed moved:

That Bill C-35, in Clause 2, be amended

(a) by replacing line 12 on page 1 with the following:

“445.01(4), may be served consecutively to any”

(b) by replacing line 15 on page 1 with the following:

“events, if the court considers it to be necessary for the proper administration of justice.”

After debate, the question was put on the amendment and it was negatived.

 

Clause 2 carried.

 

On Clause 3,

Sean Casey moved, — That Bill C-35, in Clause 3, be amended by replacing line 19 on page 1 with the following:

“who kills,”

 

After debate, the question was put on the amendment of Sean Casey and it was negatived.

 

Pursuant to the order adopted by the Committee on Tuesday, October 29, 2013, the following amendment, submitted by Bruce Hyer for the consideration of the Committee, was deemed moved:

That Bill C-35, in Clause 3, be amended by replacing lines 5 to 8 on page 2 with the following:

“five years; or”

After debate, the question was put on the amendment and it was negatived.

 

Clause 3 carried.

 

Clause 4 carried.

 

Clause 1, Short Title, carried.

 

The Title carried.

 

The Bill carried.

 

ORDERED, — That the Chair report the Bill to the House.

Pursuant to the Order of Reference of Wednesday, November 26, 2014, the Committee resumed consideration of the subject matter of Bill C-583, An Act to amend the Criminal Code (fetal alcohol spectrum disorder).
 

It was agreed, — That the draft report, as amended, be adopted.

 

It was agreed, — That the report be entitled: "Study on the subject matter of Bill C-583, An Act to amend the Criminal Code (fetal alcohol spectrum disorder)".

 

It was agreed, — That the Chair, Clerk and analyst be authorized to make such grammatical and editorial changes as may be necessary without changing the substance of the report.

 

It was agreed, — That the Chair present the report to the House.

 

It was agreed, — That, pursuant to Standing Order 109, the Committee request that the Government table a comprehensive response to the report.

 

It was agreed, — That the Committee append to its report dissenting and/or supplementary opinions, immediately after the signature of the Chair, provided that they are no more than 4 pages, in the same style and format as the report; and that it be submitted electronically in both official languages to the Clerk of the Committee, no later than noon on Thursday, May 7, 2015.
