The Standing Committee on Transport, Infrastructure and Communities met at 3:33 p.m. this day, in Room 209, West Block, the Chair, Merv C. Tweed, presiding.

 

Members of the Committee present: Dennis Bevington, Lois Brown, Sukh Dhaliwal, Candice Hoeppner, Brian Jean, Mario Laframboise, Colin Mayes, Merv C. Tweed, Hon. Joseph Volpe and Jeff Watson.

 

Acting Members present: Scott Andrews for Gerard Kennedy, Gérard Asselin for Roger Gaudet and Andrew Kania for Gerard Kennedy.

 

In attendance: Library of Parliament: John Christopher, Analyst; Allison Padova, Analyst. House of Commons: Wayne Cole, Legislative Clerk.

 

Witnesses: Department of Transport: Mark Gauthier, General Counsel, Legal Services; Tim Meisner, Director General, Marine Policy; Jerry Rysanek, Executive Director, International Marine Policy and Liability.

 

By unanimous consent, Sukh Dhaliwal moved, — That the Committee request, for each sitting week starting May 12, 2009, the appearance of witnesses from Transport Canada and Infrastructure Canada to provide an update to the Committee and Canadians on the government’s implementation of Budget 2009, including the projects approved, the location of projects by region or province, the amount of expenditures, the details regarding any other funding partners as well as the expected time of expenditure and completion.

Debate arose thereon.

 

The question was put on the motion and it was negatived, by a show of hands: YEAS: 4; NAYS: 7.

 
Pursuant to the Order of Reference of Monday, March 30, 2009, the Committee resumed consideration of Bill C-7, An Act to amend the Marine Liability Act and the Federal Courts Act and to make consequential amendments to other Acts.
 

The Committee resumed its clause-by-clause study of the Bill.

 

The witnesses answered questions.

 

Clause 10 carried.

 

On Clause 11,

Andrew Kania moved, — That Bill C-7, in Clause 11, be amended by replacing line 17 on page 53 with the following:

“or in respect of a ship, or if a maritime lien is enforced pursuant to section 139, they may make a”

 

After debate, the question was put on the amendment of Andrew Kania and it was negatived, by a show of hands: YEAS: 3; NAYS: 6.

 

Clause 11 carried.

 

On Clause 12,

Joseph Volpe moved, — That Bill C-7, in Clause 12, be amended by replacing lines 6 to 8 on page 59 with the following:

“for claims that arise from a contract with the vessel owner or with a person authorized by the vessel owner

(a) relating to goods, materials or services wherever supplied to the foreign vessel for its”

 

After debate, by unanimous consent, the amendment was withdrawn.

 
Brian Jean moved, — That Bill C-7, in Clause 12, be amended by

(a) replacing line 8 on page 59 with the following:

“wherever supplied to the foreign vessel for its”

(b) replacing line 13 on page 59 with the following:

“equipping of the foreign vessel. Stevedoring or lighterage

(2.1) Subject to section 251 of the Canada Shipping Act, 2001, for the purposes of paragraph (2)(a), with respect to stevedoring or lighterage, the services must have been provided at the request of the owner of the foreign vessel or a person acting on the owner’s behalf.”

 

The question was put on the amendment of Brian Jean and it was agreed to, by a show of hands: YEAS: 10; NAYS: 0.

 

By unanimous consent, it was agreed, — That the result of the vote on the previous amendment be applied to the following amendment which is therefore also adopted:

That Bill C-7, in Clause 12, be amended by replacing, in the English version, line 11 on page 59 with the following:

“stevedoring and lighterage; or”

 

Clause 12, as amended, carried.

 

Clauses 13 to 24 inclusive carried severally.

 

The Schedule carried.

 

The Title carried.

 

The Bill, as amended, carried.

 

ORDERED, — That the Chair report the Bill, as amended, to the House.

 

ORDERED, — That Bill C-7, as amended, be reprinted for the use of the House at report stage.
