THIRD REPORT		TROISIÈME RAPPORT
In accordance with the order of the Committee of Wednesday, December 1, 2004, your Committee held meetings with the Deputy Clerk of the House and the Ethics Commissioner in relation to the mandate of the Committee and on December 8, 2004, the Committee agreed to recommend to the House the following changes to the Standing Orders and to the Conflict of Interest Code for Members of the House of Commons:		Conformément à l’ordre du Comité du mercredi 1er décembre 2004, votre Comité a tenu des réunions avec le sous-greffier de la Chambre des communes et le commissaire à l’éthique concernant le mandat du Comité et le 8 décembre 2004 le Comité a convenu de recommander à la Chambre les changements suivants au Règlement et au Code régissant les conflits d’intérêts des députés :
1. That Standing Order 108(2) be amended by deleting the present text and replacing it with the following:		1. Que le paragraphe 108(2) du Règlement soit modifié par suppression du texte actuel et par son remplacement par ce qui suit :
(2) The standing committees, except those set out in sections (3)(a), (3)(f), (3)(h) and (4) of this Standing Order, shall, in addition to the powers granted to them pursuant to section (1) of this Standing Order and pursuant to Standing Order 81, be empowered to study and report on all matters relating to the mandate, management and operation of the department or departments of government which are assigned to them from time to time by the House. In general, the committees shall be severally empowered to review and report on:		(2) En plus des pouvoirs qui leur sont conférés conformément au paragraphe (1) du présent article et à l'article 81 du Règlement, les comités permanents, à l'exception des comités énumérés aux paragraphes (3)a), (3)f), (3)h) et (4) du présent article, sont autorisés à faire une étude et présenter un rapport sur toutes les questions relatives au mandat, à l'administration et au fonctionnement des ministères qui leur sont confiés de temps à autre par la Chambre. En général, les comités sont individuellement autorisés à faire une étude et présenter un rapport sur :
(a) the statute law relating to the department assigned to them;		a) les textes législatifs liés au ministère qui leur est confié;
(b) the program and policy objectives of the department and its effectiveness in the implementation of same;		b) les objectifs des programmes et des politiques du ministère et l'efficacité de leur mise en oeuvre;
(c) the immediate, medium and long-term expenditure plans and the effectiveness of implementation of same by the department;		c) les plans de dépenses immédiats, à moyen terme et à long terme, et l'efficacité de leur mise en oeuvre par le ministère;
(d) an analysis of the relative success of the department, as measured by the results obtained as compared with its stated objectives; and		d) une analyse de la réussite relative du ministère, mesurée en fonction des résultats obtenus et comparée aux objectifs énoncés; et
(e) other matters, relating to the mandate, management, organization or operation of the department, as the committee deems fit.		e) d'autres questions liées au mandat, à l'administration, à l'organisation ou au fonctionnement du ministère que le comité juge bon d'examiner.
2. That Standing Order 108(3) be amended:		2. Que le paragraphe 108(3) du Règlement soit modifié :
in paragraph (a) by deleting sub-paragraphs (vii) and (viii).		à l’alinéa a), par suppression des sous-alinéas (vii) et (viii).
in paragraph (c) by replacing sub-paragraph (vi) with the following:		à l’alinéa c), par remplacement du sous-alinéa (vi) par ce qui suit :
(vi) the review of and report on reports of the Public Service Commission which shall be severally deemed permanently referred to the Committee immediately after they are laid upon the Table;		vi) l’étude des rapports de la Commission de la fonction publique, qui sont réputés être renvoyés en permanence au Comité dès leur dépôt sur le Bureau de la Chambre, et la présentation de rapports à ce sujet;
and by adding after paragraph (g) the following:		et par adjonction, après l’alinéa g), de ce qui suit :
(h) Access to Information, Privacy and Ethics shall include, among other matters:		h) celui du Comité de l’accès à l’information, de la protection des renseignements personnels et de l’éthique comprend notamment :
(i) the review of and report on the effectiveness, management and operation together with the operational and expenditure plans relating to the Information Commissioner;		i) l'étude de l'efficacité, de l'administration et du fonctionnement du Commissaire à l’information ainsi que de ses plans opérationnels et de dépenses, et la présentation de rapports à ce sujet;
(ii) the review of and report on the effectiveness, management and operation together with the operational and expenditure plans relating to the Privacy Commissioner;		ii) l'étude de l'efficacité, de l'administration et du fonctionnement du Commissaire à la protection de la vie privée ainsi que de ses plans opérationnels et de dépenses, et la présentation de rapports à ce sujet;
(iii) the review of and report on the effectiveness, management and operation together with the operational and expenditure plans relating to the Ethics Commissioner;		iii) l'étude de l'efficacité, de l'administration et du fonctionnement du Commissaire à l’éthique ainsi que de ses plans opérationnels et de dépenses, et la présentation de rapports à ce sujet;
(iv) the review of and report on reports of the Privacy Commissioner, the Information Commissioner and the Ethics Commissioner and on reports tabled pursuant to the Lobbyists Registration Act, which shall be severally deemed permanently referred to the Committee immediately after they are laid upon the Table;		iv) l’étude des rapports du Commissaire à la protection de la vie privée, du Commissaire à l’information et du Commissaire à l’éthique et des rapports déposés en application de la Loi sur l’enregistrement des lobbyistes, tous réputés être renvoyés en permanence au Comité dès leur dépôt sur le Bureau de la Chambre, et la présentation de rapports à ce sujet;
(v) in cooperation with other committees, the review and report on any federal legislation, regulation or standing order which impacts upon the access to information or privacy of Canadians or the ethical standards of public office holders;		v) de concert avec d’autres comités, l’étude de tout projet de loi ou règlement fédéral ou de toute disposition du Règlement qui a une incidence sur l’accès à l’information ou la protection des renseignements personnels des Canadiens ou sur les normes en matière d’éthique des titulaires de charge publique;
(vi) the proposing, promoting, monitoring and assessing of initiatives which relate to access to information and privacy across all sectors of Canadian society and to ethical standards relating to public office holders;		vi) la formulation de propositions d’initiatives en matière d’accès à l’information et de protection des renseignements personnels de toutes les tranches de la société canadienne et des normes en matière d’éthique des titulaires de charge publique, ainsi que la promotion, le contrôle et l’évaluation de ces initiatives;
(vii) the review of and report on all matters relating to the Conflict of Interest Code for Members of the House of Commons;		vii) l’examen de toute question relative au Code régissant les conflits d’intérêt des députés et la présentation de rapport à ce sujet;
and any other matter which the House shall from time to time refer to the Standing Committee.		ainsi que toute autre question que la Chambre renvoie au besoin au Comité permanent.
3. That subsection 30(1) of the Conflict of Interest Code for Members of the House of Commons be amended by deleting the present text and replacing it with the following:		3. Que le paragraphe 30(1) du Code régissant les conflits d’intérêts des députés soit modifié par suppression du texte actuel et par son remplacement par ce qui suit :
30. (1) The Ethics Commissioner shall submit any proposed rules for the administration of this Code to the Standing Committee on Access to Information, Privacy and Ethics.		30. (1) Le commissaire soumet au Comité permanent de l'accès à l'information, de la protection des renseignements personnels et de l'éthique tout projet de règle d’application du présent code.
4. That section 33 of the Conflict of Interest Code for Members of the House of Commons be amended by deleting the present text and replacing it with the following:		4. Que l’article 33 du Code régissant les conflits d’intérêts des députés soit modifié par suppression du texte actuel et par son remplacement par ce qui suit :
33. The Standing Committee on Access to Information, Privacy and Ethics shall, within five years of the coming into force of this Code and every five years thereafter, undertake a comprehensive review of its provisions and operation, and shall submit a report thereon, including a statement of any changes the Committee recommends.		33. Dans les cinq ans suivant l’entrée en vigueur du présent code et tous les cinq ans par la suite, le Comité permanent de l'accès à l'information, de la protection des renseignements personnels et de l'éthique procède à un examen exhaustif des dispositions du présent code et de son application, et présente un rapport assorti des modifications qu’il recommande, le cas échéant.
