Meeting No. 42

Wednesday, May 14, 2003

The Standing Committee on Government Operations and Estimates met at 3:45 p.m. this day, in Room 362, East Block, the Chair, Reg Alcock, presiding.

Members of the Committee present: Reg Alcock, Carolyn Bennett, Roy Cullen, Paul Forseth, Robert Lanctôt, Judy Sgro, Paul Szabo, Tony Tirabassi and Tony Valeri.

Acting Members present: Yvon Godin for Pat Martin; David Price for Steve Mahoney and Larry Bagnell for Raymonde Folco.

In attendance: From the Library of Parliament: Jack Stilborn, Analyst.

Witnesses: From the Human Resources Modernization Task Force: Ranald A. Quail, Deputy Minister and Head; Monique Boudrias, Assistant Deputy Minister and Senior Advisor; Yvette Aloisi, Director General, Institutional Reform, Memorandum to the Cabinet Development; Michel LeFrançois, General Counsel; Lois Pearce, Director General, Policy; John Mooney, Legal Counsel. Pursuant to its Order of Reference of Thursday, February 20, 2003, the Committee resumed consideration of Bill C-25, An Act to modernize employment and labour relations in the public service and to amend the Financial Administration Act and the Canadian Centre for Management Development Act and to make consequential amendments to other Acts (See Minutes of Proceedings, Thursday, February 27, 2003, Meeting No. 12).

It was agreed that the Committee invite the Clerk of the Privy Council to appear before the Committee prior to the House recessing for the summer.

The Committee resumed Clause-by-Clause consideration of the Bill.

On Clause 208.

Clause 208, as amended carried on division.

Clauses 209 to 211 carried severally on division.

Clause 212 was allowed to stand.

Clause 213 carried on division.

Clauses 215 to 224 carried severally on division.

On Clause 225.

Tony Tirabassi moved, -- That Bill C-25, in Clause 225, be amended by replacing line 27 on page 240 with the following:

i) paragraphs 4(a) to (e) and 5(a) and subsections

The question was put on the amendment, it was agreed to, on division.

Clause 225, as amended, carried on division.

On Clause 226.

Tony Tirabassi moved, -- That Bill C-25, in Clause 226, be amended by replacing,  in the French version, line 4 on page 245 with the following:

administration » à l'expression « public service of

The question was put on the amendment, it was agreed to, on division.

Clause 226, as amended, carried on division.

Clauses 227 to 286 carried severally on division.

The Committee reverted back to Clauses 4, 33, 212 and 214.

Clauses 4, 33, 212 and 214 carried.

The Committee reverted back to Clause 12.

Paul Forseth moved, -- That Bill C-25, in Clause 12 on page 116 be amended by replacing lines 24 to 27 with the following:

“activity, that is a real or apparent conflict of interest with their functions, and the President shall devote the whole of his or her time to the performance of the President’s functions.”

After debate, the question was put on the amendment, it was negatived.

Paul Szabo moved, -- That Bill C-25, in Clause 12 be amended by replacing line 6 on page 117 with the following:

“Public Service Commission, so help me God or other preferred deity (optional)”.

After debate, the question was put on the amendment, it was agreed to.

By unanimous consent, the amendment of Paul Szabo to Clause 12 previously adopted was reconsidered.

By unanimous consent, it was allowed to stand.

Paul Szabo moved, -- That Bill C-25, in Clause 12, be amended by replacing line 6 on page 117 with the following:

Public Service Commission (add in the case where an oath is taken “so help me, God, or name of deity”)

After debate, the question was put on the amendment, it was agreed to, on division.

Paul Szabo moved, -- That Bill C-25, in Clause 12, be amended by replacing line 30 on page 133 with the following:

knowledge by reason of such employment. (Add, in the case where an oath is taken, “So help me, God” (or name of deity).)

The question was put on the amendment, it was agreed to, on division.

Paul Szabo moved, -- That Bill C-25, in Clause 12, be amended by replacing line 32 on page 148 with the following:

The question was put on the amendment, it was agreed to, on division

Paul Szabo moved, -- That the vote previously taken on Clause 19 be rescinded.

The question was put on the motion, it was agreed to, on division.

Paul Szabo moved, -- That Bill C-25, in Clause 19, be amended by replacing line 23 on page 165 with the following:

“lic Service staffing Tribunal (in the case where an oath is taken, 'so help me, God' or name of deity)”.

After debate, the question was put on the amendment, it was agreed to, on division.
